Cars, light trucks (under 12,000 pounds gross weight), SUVs, vans and self-propelled campers and recreational vehicles are eligible for Lemon Law claims. For RVs, you may only file a claim for problems with the chassis and coach.

You may file a claim for eligible vehicles registered in Georgia and purchased or leased new directly from a dealership for personal use or for fleets of fewer than 10 vehicles. Vehicles are eligible for 24 months after purchase or lease, or for 24,000 miles, whichever comes first.

Georgia Lemon Law gives you a choice between a new replacement vehicle or payment by check. If you opt for a payment, you are entitled to the following:

  • A refund of the purchase price
  • Any loan interest you paid while you owned the vehicle
  • Sales tax, government charges, dealer charges and charges for dealer-installed equipment
  • Towing, transportation and repair charges related to repair attempts

Reasonable depreciation up to the first repair visit will be deducted from this total. The formula for depreciation for most vehicles is (Purchase Price x Miles) ÷120,000. For recreational vehicles and motor homes, the formula is (Purchase Price x Miles) ÷ 90,000.
