How we handle your information.

Written to be read, not to be skimmed past. If anything here is unclear, call and ask.

This policy explains what Bad Vehicle collects when you use badvehicle.com, why we collect it, who we share it with, and what you can ask us to do about it. It is written to be read, not to be skimmed past.

Bad Vehicle is a law firm. Jonathan D. Schwartz is the attorney responsible for this site. We are located in Florida and represent consumers in Florida, New York and other states.

What we collect

Information you give us

When you book a consultation, submit a case review request, take the eligibility quiz's follow-up, call us or email us, we collect what you send. That normally includes:

  • Your name, phone number and email address
  • The year, make and model of your vehicle
  • What you tell us about the defect, the repair attempts and time out of service
  • Any documents you choose to send us, including repair orders and purchase or lease agreements

You decide what to send. You do not need an account to use this site, and we do not ask for a Social Security number, driver's licence number or payment details through this website.

The eligibility quiz on this site runs entirely in your browser. Your answers are not transmitted to us and are not stored. If you want us to look at your situation after taking it, you contact us separately.

Information collected automatically

Like most websites, this one records technical information when you visit: IP address, browser type and version, device type, the pages you open, the time and date of the visit, and the page that referred you. This is used to keep the site working and to understand which pages are useful.

Cookies and similar technologies

We use cookies for three things: keeping the site functioning, measuring traffic, and remembering your language preference if you use the translation feature. You can refuse cookies in your browser settings. Some parts of the site may not work normally if you do.

Phone calls and text messages

This section matters, so it is separate.

If you check the consent box on a form, you are agreeing to receive calls and text messages from Bad Vehicle at the number you provided, including messages sent by automated means. Message frequency varies. Message and data rates may apply.

You can stop at any time. Reply STOP to any text message to opt out, or HELP for help. Opting out of text messages does not withdraw a request for legal help and does not affect any existing matter — it only stops the texts. You can also tell us by email or on the phone.

Consent to receive messages is not a condition of representation. We do not sell or rent your phone number, and we do not share it with third parties for their own marketing.

How we use what we collect

  • To evaluate whether we may be able to help with your vehicle
  • To contact you about that evaluation and, if you become a client, about your matter
  • To meet our professional and legal obligations as a law firm
  • To keep the site secure and working
  • To understand which pages and topics are useful, in aggregate

We do not sell your personal information. We do not share it with other law firms, lead brokers or marketing companies.

Who we share it with

We use a small number of service providers to run this site and the intake process. They only receive what they need to do their job, and they are not permitted to use it for their own purposes:

  • Calendly — scheduling consultations. Receives your name, email and any details you enter when booking.
  • Google Analytics — traffic measurement, in aggregate.
  • Trustindex — displaying reviews published on Google. It does not receive your information; it brings reviews in.
  • Weglot — translating the site into other languages.
  • Cloudflare — content delivery and protection against attacks.
  • Our website host and our email provider.

We may also disclose information if the law requires it, in response to valid legal process, or where necessary to protect our rights or someone's safety. If the firm is ever involved in a merger, acquisition or sale of assets, information may transfer as part of that — you would be notified.

Confidentiality and the attorney-client relationship

Sending us information through this website does not create an attorney-client relationship. That relationship begins only when we and you both agree in writing that we represent you.

Until then, information you send is not protected by the attorney-client privilege in the way communications with your own lawyer are. Please do not send confidential or sensitive details of a matter through the website forms. Tell us enough for us to see whether we can help, and we will tell you when it is appropriate to share more.

Once we do represent you, the information relating to your matter is protected under the applicable rules of professional conduct, which are stricter than this policy.

How long we keep it

If you contact us and we do not end up working together, we keep your inquiry only as long as we need it to document that we declined the matter and to avoid conflicts of interest later — normally a few years. If you become a client, file retention follows the rules that apply to lawyers in the relevant state, which generally require keeping files for a set period after a matter closes.

Technical logs are kept for a short period and then discarded.

Security

The site runs over an encrypted connection and access to intake information is limited to the people at the firm who need it. No website or method of transmission over the internet is completely secure, and we cannot guarantee absolute security. If you have something genuinely sensitive to share, call us instead of typing it into a form.

Your choices

You can ask us to:

  • Tell you what personal information we hold about you
  • Correct it if it is wrong
  • Delete it, where we are not required to keep it
  • Stop contacting you, by any or all channels

Email [email protected] or call 1-855-223-8344. We will respond within the time the applicable law allows.

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what is collected and the right to delete it. We do not sell or share personal information as those terms are defined under that law, so there is nothing to opt out of on that front. You will not be treated differently for exercising any of these rights.

Children

This site is not directed to children under 13 and we do not knowingly collect information from them. If you believe a child has sent us information, contact us and we will delete it.

Links to other sites

This site links to pages we do not control, including manufacturer recall notices and government resources. We are not responsible for their privacy practices. Read their policies before giving them information.

Changes to this policy

If we change this policy we will update the date at the top of this page. If the change is significant, we will say so on the site. Continuing to use the site after a change means you accept the updated policy.
