What vehicles are eligible for Lemon Law claims?
Only new, previously unowned vehicles, including demonstration vehicles, purchased or leased from a dealership are eligible for Albany Lemon Law compensation. Vehicles must have been purchased in the last 24 months or have fewer than 18,000 miles, whichever comes first. The New York Lemon Law allows a refund of 100% of the purchase price if the vehicle’s defect first appears within 12,000 miles. The purchase price is the amount you paid for the vehicle, not its suggested retail price or book value.
Between 12,000 and 18,000 miles, depreciation is calculated at a standard rate of (Mileage – 12,000) x Price / 100,000.
