Are All Vehicles Covered By The New York Lemon Law?

In New York, Lemon Law coverage is quite comprehensive compared to that in other states. This legal protection for buyers covers those who purchase cars, trucks, SUVs, vans, and recreational vehicles. In the case of the RV, only the automotive parts of the vehicle are covered under the New York Lemon Law. In addition, the vehicle must have been purchased in the state or leased as a new vehicle within the past 24 months or have fewer than 18,000 miles on it, less any mileage listed on the transfer documentation.

Are There Other Requirements That Must Be Met?

Before a vehicle can be considered a lemon, the manufacturer must have been given ample opportunity to correct any issue or defect. In New York, you can seek Lemon Law protection after taking your vehicle in for repair three or more times, and it is still not resolved, or in many cases, if the car was out of service or un-drivable for a total of 30 days or more. When the vehicle meets all of these criteria, a lemon law claim can be completed and filed with the state along with the $250 filing fee, which your New York Lemon Law Lawyer will cover until the case is resolved.

What Compensation Can I Get For My Lemon Vehicle?

When a vehicle was purchased new in New York and is found to be a lemon, you can request a Lemon Buyback and receive:

  • The amount paid for the car, including the trade-in amount and the cost of any optional equipment/span>
  • The cost of the title, registration, and government fees paid at closing
  • Sales tax
  • Legal costs and attorney’s fees

If the vehicle was determined to be a lemon in the first 12,000 miles of use, the reimbursement for the car is 100% of these costs. If the defects are found within the next 6,000 miles, the amount paid will be a depreciated rate to account for the vehicle’s use prior to the buyback. In the case of a lease, you can recover your down payment amount, any trade-in allowance, and the monthly lease payments, less any interest and service fees. You would also have your legal fees paid.

Please don’t hesitate to get in touch with the expert New York Lemon Law Lawyers at Bad Vehicle today to learn more about getting the compensation you deserve for the lemon vehicle you purchased.

New York Lemon Law Basics

How does New York’s Lemon Law work and what does it cover?

New York’’s Lemon Law, officially known as the Motor Vehicle Warranty Enforcement Act, protects consumers who buy or lease new vehicles with significant defects. If a vehicle has a recurring issue that the manufacturer fails to fix after a “reasonable number” of repair attempts, the consumer may be entitled to a refund or a replacement.

Before taking legal action, consumers are required to try resolving the matter through the manufacturer’s informal dispute resolution process (usually arbitration). This involves submitting documentation and giving the manufacturer a final chance to repair the issue. If the dispute isn’t resolved in arbitration, the consumer can take the case to court.

The law covers new vehicles and some motor vehicles like RVs (but not their living facilities). Salvage vehicles and cars without warranty are not covered.

New York’’s state Lemon Law only applies to new vehicles. However, used cars can still be protected under the federal Magnuson-Moss Warranty Act, as long as the defect is reported during the vehicle’s warranty period.

So if you buy a used car and it still has a valid manufacturer or dealer warranty, and a defect appears during that time, you may still have a case. This federal law doesn’t care whether the vehicle is new or used — it focuses on whether the warranty is active and whether the defect was properly reported.

If your vehicle qualifies and the manufacturer fails to fix the defect after multiple repair attempts, you need to:

  • Step 1: Send a written notice to the manufacturer via certified or express mail.
  • Step 2: Allow the manufacturer one final repair attempt.
  • Step 3: If the issue persists, submit a Request for Arbitration with Florida’s Department of Legal Affairs along with supporting documents.
  • Step 4: Attend arbitration. If the outcome isn’t favorable, you may file a lawsuit.

An attorney can help handle these steps and increase your chances of a successful outcome.

Yes, leased vehicles are covered under New York’’s Lemon Law — as long as the defect appears during the lease and meets the same conditions as a purchased vehicle.

However, keep in mind: if you’re leasing, your refund is limited to the amount you’ve paid into the lease. You won’t be refunded for the full vehicle value since you don’t own the car.

Hiring a Lemon Law attorney gives you a big advantage. Manufacturers have deep pockets and legal teams — going up against them alone can be difficult. An experienced attorney knows how to handle the process, file correctly, and present your case with strong documentation.
