Lemon Law compensation varies from case to case, depending on the circumstances of the claim. If you receive a Lemon Buyback, in which the manufacturer repurchases the vehicle from you, you will receive the following compensation:

For purchased vehicles:

  • Vehicle price, including the value of any trade-in, plus the price of optional equipment
  • Title and registration fees, as well as any additional government fees
  • Sales tax
  • Reasonable attorney’s fees

The New York Lemon Law allows a refund of 100% of the purchase price if the vehicle’s defect first appears within 12,000 miles. The purchase price is the amount you paid for the vehicle, not its suggested retail price or book value.

Between 12,000 and 18,000 miles, depreciation is calculated at a standard rate of (Mileage – 12,000) x Price / 100,000.

For leased vehicles:

  • Down payment and trade-in allowance plus all monthly lease payments, minus interest charges and service fees
  • Reasonable attorney’s fees
