Two Different Vehicles, One Name

Which Hummer do you have? The answer changes everything.

The standalone Hummer brand was wound down in 2010. The name came back in 2021 as a GMC sub-brand. Those are two different situations and only one of them has a live Lemon Law claim.

Substantial Defect

One that impairs the use, value or safety of the vehicle. Stalling, brake failure, steering and persistent electrical faults qualify. A rattle generally does not.

Repair Attempts

Florida looks for three attempts at the same defect. New York looks for four. Recall work and visits that found nothing both count.

Days Out of Service

Thirty cumulative days in Florida and in New York. Cumulative, not consecutive, and the days count whether or not anything was fixed.

Coverage Window

The defect has to be reported while the vehicle is inside the warranty or rights period. When it was reported matters more than today's date.

If you own a GMC Hummer EV, you are a General Motors claimant. NHTSA files every current campaign under General Motors, LLC with the make recorded as GMC, and a demand letter names General Motors, not Hummer. US sales ran 854 in 2022, 3,244 in 2023, 13,993 in 2024 and 15,788 in 2025 — so roughly 30,000 of the 34,000 ever sold arrived in the last two years, and almost the whole fleet is inside a Lemon Law and warranty window right now.

If you own an H1, H2 or H3, the position is different and it is worth being straight about it. Those were built between 2003 and 2010 under the standalone brand, which General Motors wound down — the H2 ended in 2009 and the H3 and H3T in 2010. They are fifteen years or more past any state Lemon Law window.

That does not always mean nothing. Federal warranty law can reach a vehicle with active warranty coverage, and dealer misrepresentation or undisclosed damage at the point of sale is a separate matter entirely. But it is not a Lemon Law claim, and anyone telling you otherwise is wasting your time.

Recall or Claim

A recall says GM knows. A claim says they were given the chance to fix it.

A recall is the manufacturer acknowledging that a defect exists across a population of vehicles and offering a remedy. It is a public admission of the fault pattern, which makes it useful evidence. What it is not is a Lemon Law claim.

The claim arises from what happened to your vehicle: the defect was reported, the dealership was given a reasonable number of attempts to repair it, and it is still there.

Most GM campaigns bundle the Hummer EV in with other GM nameplates, so there is no Hummer-only recall total to quote. One recent campaign covers only the 2026 Hummer EV SUV and Pickup: 354 vehicles whose front passenger airbag connection may have an improperly crimped wire.

Recurring Hummer Faults

WHAT KEEPS COMING BACK.

These are the defect categories that generate the most Lemon Law and warranty claims involving the GMC Hummer EV. A vehicle showing one of these is not automatically a claim. A vehicle showing one of these repeatedly and unrepaired usually is.

Battery Pack Water Ingress

An improperly sealed high-voltage battery pack enclosure lets water in and can cut drive power entirely, in a campaign covering the 2022 Hummer EV and 2023 Hummer EV Pickup.

Rear Drive Unit Wiring Short

Insufficiently insulated motor wires in the rear drive unit can touch and short, producing a loss of drive power severe enough that GM's remedy was full replacement of the rear drive unit.

Passenger Airbag Crimp Fault

An improperly crimped wire at the front passenger airbag connection can stop the airbag deploying in a crash, in a campaign covering 354 model-year 2026 Hummer EV SUV and Pickup vehicles exclusively.

Lighting and Radio Configuration

Taillight software that leaves rear lamps inoperative or permanently lit, and radio modules misconfigured at the factory, show a pattern of software-set functions failing at delivery rather than through use.

Service Brake Complaints

Service brakes rank among the top three NHTSA complaint categories for the Hummer EV across the 2024 and 2025 model years, alongside the electrical system and forward collision avoidance.

Electronic Owner's Manual Missing

Radios not configured in production to download the electronic owner's manual left owners without operating and safety instructions, a federal non-compliance covering 2026 Hummer EV models among other GM vehicles.
