What Decides It

Hyundai built it, but Hyundai does not decide it. These four questions decide it, and the repair orders in your glovebox answer all four.

Substantial Defect

One that impairs the use, value or safety of the vehicle. Stalling, brake failure, steering and persistent electrical faults qualify. A rattle generally does not.

Repair Attempts

Florida looks for three attempts at the same defect. New York looks for four. Recall work and visits that found nothing both count.

Days Out of Service

Thirty cumulative days in Florida and in New York. Cumulative, not consecutive, and the days count whether or not anything was fixed.

Coverage Window

The defect has to be reported while the vehicle is inside the warranty or rights period. When it was reported matters more than today's date.

Hyundai owns two of the best-documented defect programmes in the American market. The Theta II engine settlement — connecting-rod bearing wear causing seizure, stalling and fire — added 2.1 million vehicles and a 15-year, 150,000-mile warranty extension for that failure. The anti-theft settlement with 35 attorneys general covers every 2011-2022 Hyundai built without a factory immobiliser.

Genesis claims run under Hyundai. Genesis is Hyundai's luxury division and Genesis VINs sit inside Hyundai Motor America's own campaigns — the G90 in the 294,448-vehicle seat belt anchor recall, the GV60, GV70 Electrified and G80 Electrified in the 145,642-vehicle charging unit recall. A Genesis claim is a Hyundai Motor America claim.

One condition on the Theta II settlement is worth knowing and is easy to miss: the knock-sensor software update generally had to be performed within 150 days of settlement notice to keep access to the extended warranty. Owners who skipped it may have lost coverage they did not know they had.

Recall or Claim

A recall says Hyundai knows. A claim says they were given the chance to fix it.

A recall is the manufacturer acknowledging that a defect exists across a population of vehicles and offering a remedy. It is a public admission of the fault pattern, which makes it useful evidence. What it is not is a Lemon Law claim.

The claim arises from what happened to your vehicle: the defect was reported, the dealership was given a reasonable number of attempts to repair it, and it is still there. With Hyundai there is usually plenty of documentation to point at — the difficulty is that owners assume a settlement replaces a claim. It does not.

A class settlement extends a warranty. It does not buy your vehicle back, and it does not stop you pursuing a Lemon Law or warranty claim on a vehicle that has been in and out of the shop for the same unresolved fault.

Recurring Hyundai Faults

These are the defect categories that generate the most Lemon Law and warranty claims against Hyundai. A vehicle showing one of these is not automatically a claim. A vehicle showing one of these repeatedly and unrepaired usually is.

Theta II Engine Seizure

Connecting-rod bearing wear in Theta II 2.4L, Nu 2.0L and Gamma 1.6L GDI engines causes seizure, stalling and fire. A class settlement added 2.1 million vehicles and a 15-year, 150,000-mile warranty extension.

Phantom Emergency Braking

Forward collision-avoidance software misreads the front camera and brakes for no reason. Campaign 26V316 covers 423,062 model-year 2025-2026 Tucson, Tucson Hybrid, Tucson PHEV and Santa Cruz vehicles.

EV Charging Unit Failure

The Integrated Charging Control Unit stops charging the 12-volt battery until the car loses propulsion. Recall 24V868 covered 145,642 Ioniq 5, Ioniq 6 and Genesis EVs after 57 US incidents.

Seat Belt Anchor Detachment

Front seat belt anchors can pull free of the seat frame and fail to restrain occupants in a crash. Campaign 26V218 covers 294,448 Santa Fe, Santa Fe Hybrid, Ioniq 6 and Genesis G90 vehicles.

Instrument Cluster Blackout

A software fault blanks the instrument panel so the speedometer, tire-pressure readout and warning lamps disappear. Campaign 26V400 covers 96,310 model-year 2025-2026 Tucson variants.

Missing Engine Immobilizer

Model-year 2011-2022 Hyundais built without factory engine immobilizers are trivially stolen. A December 2025 settlement with 35 attorneys general forced free ignition-cylinder protectors and immobilizers on future vehicles.
