Substantial Defect

One that impairs the use, value or safety of the vehicle. Stalling, brake failure, steering and persistent electrical faults qualify. A rattle generally does not.

Repair Attempts

Florida looks for three attempts at the same defect. New York looks for four. Recall work and visits that found nothing both count.

Days Out of Service

Thirty cumulative days in Florida and in New York. Cumulative, not consecutive, and the days count whether or not anything was fixed.

Coverage Window

The defect has to be reported while the vehicle is inside the warranty or rights period. When it was reported matters more than today's date.

Nissan's current exposure runs through one engine. The 1.5-litre three-cylinder VC-Turbo in the Rogue produced two campaigns filed on the same day in February 2026 — 323,917 vehicles whose engine oil breaks down until the bearings seize, and 318,782 whose electronic throttle body gears can break and cut drive power. A third campaign, 25V437, had already covered 443,899 Altima, Rogue and Infiniti vehicles for defective engine bearings.

Infiniti claims run under Nissan. Infiniti is Nissan's luxury division and Infiniti VINs sit inside Nissan North America's own campaigns — the QX50 and QX55 in 25V437, the QX60 in the brake caliper campaign. An Infiniti claim is a Nissan North America claim.

Then there is the CVT. Nissan's Jatco continuously variable transmissions judder, overheat and fail, and a $277.7 million class settlement extended CVT warranties on the 2014-2018 Rogue, 2015-2018 Pathfinder and 2015-2018 QX60. That settlement is closed to new claims, but it remains evidence of a known defect.

Recall or Claim

A recall says Nissan knows. A claim says they were given the chance to fix it.

A recall is the manufacturer acknowledging that a defect exists across a population of vehicles and offering a remedy. It is a public admission of the fault pattern, which makes it useful evidence. What it is not is a Lemon Law claim.

The claim arises from what happened to your vehicle: the defect was reported, the dealership was given a reasonable number of attempts to repair it, and it is still there.

The VC-Turbo remedy is unusually involved — ECM reprogramming, inspection, an oil pan examination and engine replacement if needed. An engine replacement means a long time without the vehicle, and those days count toward the out-of-service threshold whether or not the repair eventually works.

Recurring Nissan Faults

WHAT KEEPS COMING BACK.

These are the defect categories that generate the most Lemon Law and warranty claims against Nissan. A vehicle showing one of these is not automatically a claim. A vehicle showing one of these repeatedly and unrepaired usually is.

VC-Turbo Bearing Seizure

Defective bearings and heat-degraded oil seize VC-Turbo engines, causing power loss and block-breaching fires. Campaigns 25V437 and 26V080 together cover 767,816 Rogue, Altima, QX50 and QX55 vehicles.

CVT Shudder and Failure

Jatco continuously variable transmissions judder, overheat and fail outright. A $277.7 million class settlement extended CVT warranties on the 2014-2018 Rogue, 2015-2018 Pathfinder and 2015-2018 QX60.

Throttle Body Gear Breakage

Gears inside the electronic throttle body assembly can break and cut drive power without warning. Campaign 26V081 covers 318,782 model-year 2024-2025 Rogues with the 1.5-litre VC-Turbo.

Rearview Camera Blackout

The centre display shows a blank screen in reverse, breaching federal rear-visibility rules. Campaign 25V324 covers 79,755 model-year 2025 Frontier and Kicks vehicles.

Front Brake Caliper Fracture

Front brake caliper assemblies with reduced strength can break and remove front braking function entirely, in a campaign covering 2025 Murano, Pathfinder and Infiniti QX60 vehicles.

Infotainment and Electrical Faults

Freezing infotainment screens, cascading warning lights and battery or alternator faults recur across the range, generating repeat visits that rarely resolve on the first attempt.
