What is a “Lemon”?

The state of Florida considers a “lemon” as a vehicle that has one or many defects as a result of the manufacturer. These defects are considered unsafe for the passengers, diminished value, or potentially dangerous for other drivers on the road. The vehicles become “lemon” status if the manufacturer or authorized Orlando dealership is unable to correct the presented defects upon request of the consumer.

The Florida Lemon Law was put into place to help protect the consumer in the event that a vehicle was not manufactured to the standards of a road-safe car. The law covers cars, trucks, as well as recreational vehicles that were purchased from authorized dealers in the state of Florida. The Florida Lemon Law also provides coverage for some leased vehicles that meet certain criteria, such as if the consumer listed on the leased vehicle is responsible for the needed repairs. The Lemon Law for used vehicles works in a different way, but may still be covered under the Florida Lemon Law.

Orlando Lemon Law Criteria

Florida has a list of criteria that help to determine if a vehicle is in fact, a “lemon”. However, before a vehicle can be considered a “lemon”, it must have gone through at least 3 unsuccessful attempts by a certified auto service center to fix the underlying issue(s). If the vehicle remains unsafe after the 3 attempts have been made or if the vehicle has been out of service for over 30 days. For RV’s, the out of service window is set to 60 days instead of 30 days.

For your vehicle to be classified as a “lemon”, you do not have to be the original purchaser of the car or truck. If the vehicle falls within the allotted 24 month date range of the vehicle manufacturer warranty, you still qualify for lemon eligibility through the “Lemon Law Rights Period”.
